NOT ALL TITLES ARE AS GOOD AS THEY COULD BE ...

 

If you have a 'customary' or 'common law' title - or no documentation at all but know that your family has occupied property for many years - you will need to upgrade to a registered title if you ever want to sell or sub-divide the land.

This is a sample of a Registered Title.

This will always have the 'Volume' and 'Folio' numbers unique to the property, shown at the side of the front page like this one.

 

This Title is guaranteed by the government and will show the name of the people who currently own the land.

UPGRADING

Here is a sample of a Common Law Title.

These often begin with the words 'This Indenture', like this one.

 

Although quite a legal-looking document, it doesn't always mean a great deal.

We can help you apply for a Registered Title.

 

You will usually need

 

  • a recent Survey Diagram - we can get this for you if you do not have one
  • proof that property taxes are up-to-date
  • evidence from neighbours confirming the history of the property
